Dear WI observer!
I'm sure we are all enjoying the Trump victory!! But in Wisconsin there is still a lot of work that has to get done!
The Wisconsin Election Commission (WEC) has submitted observer permanent administrative rules to the Wisconsin Legislature. It is called CR24-032. They took the Wisconsin Statute 7.41 Public’s Right to Access and expanded the rules for observers. These rules (17 pages!), if passed, will have the full effect of the law. If they don’t pass, we continue to act according to the existing 7.41 statute as we always have.
This call to action is a request for each of you to communicate your opinion of these rules. If you are able to attend the hearing:

If you cannot attend in person, please send your comments by Monday, Feb 3rd at noon (cc your Wisconsin State Representative to your email). When contacting your Assembly Rep. please state you do not want the rules as written in CR24-032 to be passed and your reasons why (state a few things if you'd like).
It is highly preferable to present your comments in person. No time limit has been set, but suggest you keep your comments to around 3 minutes or less. There will be two WEC Commissioners present to defend their rule; one Republican and one Democrat.
It’s extremely important that they hear from those that have observing experience and will continue to participate. WE are part of the election process and are the ones that will feel the full force of these rules if they are passed!

The issues with these rules, but are not limited to, are the following:
1) It’s excessive. The language controls every single move an observer may make or take.
2) The positioning of observers in a polling place throughout the entire text is too restrictive. The chief would be allowed to restrict observers to one area. If we are restricted to one area, we simply cannot observe "all public aspects of the voting process". Remember, it was a Milwaukee observer that was able to get close enough to a tabulator that triggered a recount in Milwaukee during the last election.
3) The 3 to 8 feet restriction in § 7.41 is restrictive enough. How many observers already experience chiefs that concentrate on the 8 foot part of the statute and forget that we can be as close as 3 feet?
4) Having access to restrooms (see EL4.03(8)), is agreeably a good thing, but that was only an issue because of the actions of two clerks in Racine, and it was already resolved for the 2024 November election. I believe this is a “humane” issue, not an issue where a law has to be made.
5) EL 4.04 states: No observer may create or transmit photographs, videos, or audio recordings of any observable location except as expressly permitted. This rule restricts the ability of observers at central count locations to have supporting evidence of their complaints.
5) There are many chiefs that allow observers into the polling place before 7:00 start time to get settled and observe the zeroing of the tabulators. EL4.05(1)(a) does not allow for that.
6) Observing the return of absentee ballots by the US Postal Service to a clerk’s office or alternate site would not be allowed in some instances. See EL4.05(2)(a).

I oppose the proposed Permanent Observer Rules presented by the Wisconsin Election Commission for the following reasons:
Overly Restrictive: The rules micromanage every observer’s actions.
“Positioning of observers” is too restrictive: Observers should not be restricted to a single area, as voting is a public process. Various language in the Rules directly conflicts with Wisconsin Statute § 7.41 that states election observers are able to observe "all public aspects of the voting process". The 3- to 8-foot rule in §7.41 is restrictive enough. Many observers already experience chiefs that concentrate on the 8-foot part of the statute and forget that we can be as close as 3 feet.
Polling Place Access: Some chiefs allow observers in before 7:00 AM to observe tabulator zeroing, but EL 4.05(1)(a) prohibits this.
Absentee Voting in Residential Care Facilities and Retirement Homes: WEC egregiously ignores § 6.875(6)(b) that clearly states an observer can observe the election process in the room of a nursing home resident. It reads: “for purposes of the application of Wis Stat 7.41, the home or facility SHALL be treated as a polling place”. The word “SHALL” indicates something is mandatory. Observers are protected by the law to observe all aspects of the voting process wherever that may be taking place. Furthermore, closing of doors is a safety issue. Nobody has the authority to make a regulation that interferes with a statute. There isn’t one observer who cares about how someone votes. We care that the voting process was administered properly.
Absentee Ballot Observation: EL 4.05(2)(a) limits observing ballot returns in some cases.
Media vs. Observers: These rules allow media to film in polling places but prohibits observers from doing so. Absence of statutory authority.
Basic Accommodations: Access to restrooms and chairs shouldn’t require a law; prior issues have already been resolved.
Confusing & Vague Language: Many provisions, like EL 4.03(5), are confusing.
Lack of Election Official Accountability: No consequences for rogue election officials.
Blurry Definitions: EL 4.02 (12) and (13) need clarification, particularly on the meaning of “observe” (should include both seeing and hearing).
Photo ID Requirement: EL 4.04 (1) mandates ID without clear statutory authority.
In summary, I urge you to oppose these highly restrictive, confusing, broadly defined, bureaucratic rules as many conflicts with existing laws and/or have no statutory authority.
