📰⚖️🇷🇴 Conservative news outlet, ActiveNews, won a court battle against the Ministry of Foreign Affairs related to the Bâstroe (Bystroye) Canal dispute with Ukraine!
Three years ago, Ukrainian authorities began to dig in the Chilia branch of the Danube, the northernmost branch of the Danube Delta, wanting to make the Danube accessible to heavier cargo ships in order to access the ports of Reni, Izmail and Chilia.
Navigating the Danube river through the Chilia Branch is especially hard because the branch carries most of the water volume and with it, tons of alluvium creating sandbars and other hidden dangers for ships. Thus to be able to open it to heavier ships, like those who travel on the open sea, the river needs a lot of maintenance but Ukraine couldn't have carried it out, legally, without approval from Romania as both countries jointly share the river.
Digging in the area should've been a matter of public concern as, due to a number of international environmental conventions, including the 2010 Espoo Convention on the Protection of Wetlands, the Ramsar Convention on Wetlands of International Importance Especially as Waterfowl Habitat and the Danube Delta's status as a UNESCO World Heritage site give it significant legal protections from human intervention.
The Ottoman Empire had a habit of blocking foreign ships from traveling down or up the Danube on its own or at the request of either the Austrians (Habsburgs) or the Russians. The 1829 Treaty of Adrianople gave Russia the full authority to exclude all foreign ships from the Danube river but after the Crimean War the winners, the French and the British, opened up the Danube to everyone.
Following th 1856 Treaty of Paris, a Commission for the Internationalization of the Danube River was created to help organise trade and the movement of people and goods on the river. British engineers came to Ottoman held Dobrogea (Dobrudja) and dug the Sulina canal (middle branch of the Delta) shortening the route between the lower Danube and the Black Sea. At the time, it wasn't known what impact such a project had on the local fauna and flora but it became later known that such an engineering project changed breeding patterns of bird and fish species and rearranged ecosystems.
There were also some fears that by deepening the Bâstroe Canal and the Chilia branch up to the port of Reni, it could cause the Danube to overflow through the northernmost branch and deprive of water the other two branches, the St. George and Sulina branches.
At the time, Romanian authorities kept under wraps the operations carried out by Ukraine for reasons unclear to this day, perhaps the authorities being afraid of public outcry and the sowering of public opinion towards Kiev. To find out the truth, ActiveNews sued the Romanian Ministry of Foreign Affairs back in 2023 with a freedom of information request, upon refusal after refusal from the MFA to disclose what was going on in the Danube Delta.
After two years of court battles, the Bucharest Court of Appeals granted victory to ActiveNews, recognising their right to freedom of information but the MFA still refuses to comply with the court order leading ActiveNews' editors to promise to "kick down the doors" of the MFA's press bureau and get the information they wanted.
