Former Supreme Court justice David Souter died last night. It’s worth pausing to remember how far we’ve come with the courts.
Souter was a George HW Bush appointee. He was supposed to be a conservative slam dunk who would help roll back the left’s excesses like Roe v Wade. Instead, he almost instantly aligned with the Court’s left wing and remained there his entire tenure. He voted to preserve Roe v Wade. He reportedly broke down in tears when the Court didn’t make Al Gore president in 2000.
The Souter disaster taught conservatives they had to take judicial nominees extremely seriously, not just for SCOTUS but lower down in the court system. Groups like the Federalist Society developed a pipeline for young conservative lawyers to get jobs, distinguish themselves, and ultimately become judges who advance constitutional originalism. Not every pick works out perfectly, but things have vastly improved over how they once were, and we should be grateful.
