Trump has the military on his side and this has been the case since day 1
Drop 22 asks “What former President used the military to save the republic and what occurred exactly?”
The answer is of course Abraham Lincoln, who suspended Habeas Corpus and used the military to quell a domestic insurrection, which is what the Civil War truly was.
Why do you think Trump is always invoking Abraham Lincoln in his rhetoric?
Because history is repeating itself and Trump has the Constitution and PRECEDENT on his side.
What was the precedent?
The habeas corpus showdown between President Abraham Lincoln and Chief Justice Roger Taney resulted in a constitutional crisis that ultimately favored Lincoln's position. In May 1861, Taney ruled that Lincoln's suspension of habeas corpus was unconstitutional in the Ex Parte Merryman case. However, Lincoln chose to ignore Taney's ruling and continued to suspend habeas corpus throughout the Civil War.
Despite Taney's attempts to challenge Lincoln's authority, the president maintained his stance, citing the necessity to preserve the Union during rebellion. Lincoln defended his actions in a July 4th address to Congress, arguing that suspending habeas corpus was essential for executing the law and saving the nation.
Congress ultimately supported Lincoln's position. In 1863, they passed the Habeas Corpus Suspension Act, which effectively authorized the president's actions. This legislative backing strengthened Lincoln's authority and weakened Taney's objections.
The suspension of habeas corpus continued throughout the Civil War, with Lincoln expanding its scope over time. It was only partially lifted after the war's end by President Andrew Johnson.
In essence, while Taney initially challenged Lincoln's actions, the president's view prevailed, supported by Congress and the exigencies of the Civil War.
