The excerpt below is from a conversation I recently had with an incarcerated American in Virginia, USA.
This individual was incarcerated for 12months on a $1,000,000 USD “payable in full” bail bond (separate from the 10%-down bonds that are standard inside US prisons), w/ no parole option available … for a misdemeanor contempt of Court charge; specifically, defiance of a Court order.
The judge presiding over the case, which is a family law civil-action and not a criminal case, retired from the bench in 2020 but was subsequently recalled by a separate Virginia judge to preside over this particular case. It is worth noting there are large amounts of assets involved in the case.
The name of the judge in the case is Randall D Smith of Chesapeake, Virginia.
The Court order that was defied?
👉 The defendant was instructed by the judge to reallocate the assets involved in the case, and the defendant agreed to do so; defendant then requested either a laptop computer or access to his cellular phone inside the Courtroom, in order to move the monies around, and offered to do so under supervision. The judge refused the request, and sentenced him to the above, essentially declaring that his lack of access was equivalent to willful defiance of a Court order.
This individual, having no violent or criminal past record, has now been more than 50 days straight in solitary confinement inside the local jail.
Bonus Round: Did you know this same person received approx. 1/3 of the citizenry’s vote in a recent local election for county Sheriff, and openly declared his intent on the campaign trail to impanel “citizen grand juries”, to begin hearing evidence of public corruption activities and abuses inside the local judiciary?
One wonders if this coincidence is related to the Court conduct described above.
